Some of the equipment I have seen out there for example: a three and a half ton which should have a compressor of 42,000 BTUs, only has a 34,000 BTU compressor in it. Now the Department of Energy has passed on Oct. 25, 2011 , confirming the final adoption that the country will be divided into three regions. Each region will have their own efficiency standards for installation. With manufacturers facing the first implementation date of May 1, 2013, for non-weatherized furnaces followed by an effective date of Jan. 1, 2015, for central air conditioners and heat pumps. The southern region, which is involving split system a/c and heat pumps of 14 seer and gas furnaces of 80% afue. The Department of Energy is using a saving figure of $15 Billion dollars. Considering that the statistic of 40% of the equipment being installed today does not achieve the rated seer rating of the equipment. Quality installation is the direction that they should be going in, instead of raising the seer rating up another notch.

All A/C Equipment and Gas Furnaces are not equal!
In the 1990's ASHRAE wrote an article called The Peridox of High Efficiency. This article talked about laden sensible heat. As the seer rating increases the BTU output drops dramatically. (One ton of air conditioning is equal to 12,000 BTUs). Equipment manufacturers in their quest to keep up with government mandates started manufacturing condensers with decreased compressor BTU output.
